The Federal Government Department of Workers and Retired Compensation Appeals Board (WCRAB) is an independent body responsible for hearing appeals from individuals who have been denied workers’ compensation benefits. The WCRAB is located within the U.S. Department of Labor and is comprised of a three-member board that hears appeals from individuals who have been denied workers’ compensation benefits. The WCRAB is responsible for ensuring that workers’ compensation claims are properly adjudicated and that individuals receive the benefits to which they are entitled. The WCRAB is also responsible for making sure that employers and insurers comply with the requirements of the workers’ compensation system. The WCRAB is authorized to award benefits, modify or affirm decisions, and issue administrative orders.

The Board of Employee Compensation Appeals (ECAB) was established in 1946 by law to hear appeals against decisions and sentences under the Federal Employee Compensation Act with respect to claims of federal employees injured in the course of their employment. The Board has final authority to determine the federal government’s liability with respect to the disability or death of employees injured in the course of their employment. There is no further administrative or judicial appeal against ECAB decisions. The Board of Directors, by statute, is made up of three Members appointed by the United States Secretary of Laborone of whom is designated as Chairman of the Board and administrative manager.

Mission

The Board’s mission is to hear and decide cases of appeal from decisions of the Office of Workers’ Compensation Programs (OWCP) impartially and expeditiously. Council decisions are made in accordance with its statutory mandate, based on a thorough review of the case record compiled by the OWCP. Injured federal employees have the opportunity for a full evidence hearing with the OWCP Hearings and Review Department prior to the Board’s review of the record.
